Design Certifier
“Design Certifier” means the competent, registered professional person who has been commissioned by the Building Owner to design, in conjunction with others, the building or works described in the relevant Commencement Notice (or 7 Day Notice), and to certify such design is in compliance with the Second Schedule to the Building Regulations insofar as they apply to the building or works concerned, and who confirms that the documentation included in the schedule to the Commencement Notice (or 7 Day Notice) which has been prepared by him/ her, other members of the design team and specialist designers whose design activities he/ she has coordinated, has been prepared to demonstrate such compliance.
Designating Authority
The national authority responsible for setting up and carrying out the necessary procedures for the assessment and designation of conformity assessment bodies under a Mutual Recognition Agreement (MRA) or under the CETA Protocol on Conformity Assessment
Designation
An act whereby one of the parties to the CETA Protocol on Conformity Assessment or to a Mutual Recognition Agreement (MRA) informs the other party that a body, which fulfils the relevant requirements, has been designated to carry out conformity assessment according to the other partys requirements
Detinue
Detinue: Tort involving the defendant”s retention of property belonging to the plaintiff after the plaintiff has demanded its return. The plaintiff may seek damages for the period of possession, even without proving any actual loss.
Development
The legal definition of development is “the carrying out of building, mining, engineering or other operations in, on, under or over land, and the making of any material change in the use of buildings or other land” (Sec 55 of the Town and Country Planning Act 1990), this covers virtually all construction activities and changes of use.
